Federal Agency Supervision
Federal statutes and regulations apply to all major aspects of the site
closure process. Several federal regulatory agencies will play a major
role in site closure. They include the U.S. Environmental Protection
Agency and the federal Nuclear Regulatory Commission.
EPA, for instance, supervises the application of the federal Resource
Conservation and Recovery Act and the Clean Water Act's National Pollutant Discharge Elimination System (NPDES) -
each of which may apply to part of the site clean up process. The
NRC will oversee and monitor all aspects of radiological site
decommissioning, an essential predicate to the company's intention that
residual radioactivity be reduced to levels that permit the release of the
site for unrestricted use.
Other state and federal agencies that may play a role in the site closure
process include the Federal Energy Regulatory Commission (FERC) and the
U.S. Army Corps of Engineers. FERC controls activities performed near
Sherman Dam, and the Army Corps regulates the dredging and filling of
wetlands and other water bodies under the federal Clean Water Act.
